Unauthorized Baltimore company using Better Business Bureau trademark name

Unauthorized Baltimore company using Better Business Bureau trademark name
BBB Nigeria not affiliated with the Council of Better Business Bureaus

The Better Business Bureau of Greater Maryland is issuing a scam alert about bbbnigeria.com, Better Business Bureau Nigeria, a Baltimore company falsely associating itself with the Better Business Bureau.
The Council of Better Business Bureaus, Inc. trademark monitoring system discovered the website, which registered the domain on January 1, 2006. The site indicates that its' purpose is to 'act as an intermediary between the Nigerian business community and anyone interested in doing business in Nigeria.' The site also indicates that the company will be modeled after the Better Business Bureau System in the United States.
A letter was mailed via certified mail on July 17, 2006 to Mr. Duza Baba, registrant of BBBNigeria.com at 924 N. Broadway, Baltimore, the address in which is registered to the site, demanding that the company's trade and domain names be changed immediately. As of August 10, the website has been taken down.
"We want to ensure that the public knows that BBB Nigeria is not affiliated with the Council and the future operations of the BBB Nigeria as identified on their website, may not meet BBB standards," said Angie Barnett, president and CEO of the Better Business Bureau of Greater Maryland, "This alarms us as with other sound-a-likes, we do not want consumers being misled through assumption of BBB identification, expecting and holding accountable the marketplace ethics found within the Bureau's international community. Just as consumers are encouraged to check out a company before they buy, we now have to encourage them to check out their BBB contact before they put forth their trust."
Better Business Bureau and BBB are owned by the Council and cannot be used without express permission. Any use of these names by another company infringes on the BBB trademark rights, as it is likely to mislead the public about the source or origin of BBB Nigeria's services and therefore, infringes on our trademark rights.
The name Better Business Bureau and BBB are federally registered service marks owned by the Council (Reg. Nos. 566, 415, 969, 847, 971, 579, and 2,314,197). Better Business Bureau is incontestable under the Lanham Act and is used throughout the United States and on the Internet in connection with business and consumer services. Every Better Business Bureau in the U.S. is a member of the Council and must agree to abide by BBB system operating standards. Canadian BBBs are also licensed to use our marks.
