County Forest Conservation Ordinance Public Hearing
County Forest Conservation Ordinance
As part of its regularly scheduled meeting, the Washington County Board of County Commissioners will hold a public hearing on Tuesday, August 24th, 2010 at 1:15pm for the purpose of considering amendments to the text of the Washington County Forest Conservation Ordinance, and a new resolution for an increase in the Payment-in-Lieu (PIL) fee.
Changes to the Ordinance include reducing the forest disturbance threshold for a single lot exemption from 40,000 to 20,000 square feet; for a single lot exemption, revising immediate family member definition to only "child of the owner"; removing the Ordinance exemption for an area previously developed and covered by a paved surface at time of application; adding Urban Growth Area and street tree definitions and planting of approved street trees to the preferred sequence of techniques and areas for mitigation; and, other minor changes to the text of the Ordinance for the purposes of clarification and style, not meant to otherwise materially alter the intent of the Ordinance.
The Payment-in-Lieu fee of planting established by resolution of the County Commissioners will be changed from 10 cents to 30 cents per square foot in Priority Funding Areas and to 36 cents per square foot outside Priority Funding Areas in order to be in conformance with state statute. Money in the Forest Conservation Fund is used for forest planting and maintenance.
A copy of the Forest Conservation Ordinance with the proposed text amendments in its entirety and the Resolution are available for review on the County website at www.washco-md.net. Additional information is available at 240-313-2446.
